These Terms of Service ("Terms") govern your access to and use of the Sienna application and related services (the "Service") provided by Sienna ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Sienna.
By downloading, installing, or using Sienna, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 17 years of age to use Sienna. In certain jurisdictions, you must be 18 or older. By using the Service, you represent and warrant that you meet the minimum age requirement applicable in your jurisdiction.
We do not knowingly permit users under the age of 17 to create accounts or access the Service. If we learn that a user is underage, we will immediately suspend and delete their account in accordance with our Children's Safety policy (see Section 8).
You may not use the Service if you have previously been suspended or banned from the platform.

You have the right to delete your Sienna account at any time. You may do so through the following methods:
Effect of Account Deletion: Once your deletion is confirmed, your account, profile, all conversation history, and associated personal data will be permanently and irreversibly deleted. This process is completed within 30 days from active systems and within 90 days from backup systems. This action cannot be undone.

If your account is terminated by us due to a violation, you may not be eligible for a refund of any unused subscription or credits.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.
You agree to use the Service only in compliance with applicable laws and regulations. You are solely responsible for your use of the Service and any content you submit.
When using Sienna, you may not:

Sienna's AI characters are fictional entities created for entertainment, companionship, and creative expression. All AI-generated responses are automated and do not represent real people or the views of Sienna.
Any content you share within the Service (messages, images, etc.) must not infringe on the rights of third parties or violate applicable laws.
Sienna has a zero-tolerance policy for any content or conduct that exploits, harms, or endangers minors. The safety of children is our highest priority.
Sienna is strictly intended for users aged 17 and older. We employ age-verification measures to prevent minors from accessing our platform. Users in jurisdictions requiring a higher minimum age must comply with local law.

Parents and guardians are responsible for monitoring their children's device usage. We strongly encourage the use of parental control software to prevent access to age-restricted applications. If you believe your child has accessed Sienna, contact us at [email protected] and we will take immediate action to remove any associated data.
Sienna complies with the Children's Online Privacy Protection Act (COPPA), the EU General Data Protection Regulation (GDPR) as it applies to minors, and all other applicable children's protection laws. We reserve the right to use any legally available technical measures to detect and prevent underage access.
Sienna may offer free and paid subscription tiers. By purchasing a subscription, you agree to:
We reserve the right to modify pricing at any time. We will provide at least 30 days' notice before any price changes take effect for existing subscribers.
All content, features, and functionality of the Service — including but not limited to AI characters, software, design, text, graphics, and logos — are owned by Sienna and protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of any original content you create and submit through the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely to provide and improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content is not guaranteed to be accurate, reliable, or appropriate for all purposes.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIENNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, as determined by applicable law.
We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification or email at least 14 days before the new terms take effect.
Your continued use of the Service after the updated Terms take effect constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
